1. Definitions
“Company” refers to Mark Real Estate, acting as a registered channel partner in real estate transactions.
“Client” refers to any individual or entity engaging with Mark Real Estate for the purpose of purchasing, selling, or leasing property.
“Developer” refers to the builder or project owner from whom the property originates.
“Channel Partner” refers to Mark Real Estate’s role as an intermediary between clients and developers.
2. Scope of Services
Mark Real Estate offers the following services:
Marketing and promotion of residential and commercial properties.
Client acquisition and property consultation.
Site visits, negotiations, and coordination with developers.
Assistance in documentation, bookings, and post-sale support.
3. Commission Structure
Commission will be paid by the developer or client, as per the agreed terms for each project.
Commission is subject to successful closure and fulfillment of payment milestones by the client.
Payment timelines and structure shall vary by project and will be communicated in writing.
4. Client Obligations
Clients must provide accurate personal and financial details for bookings and verification.
Clients must comply with the terms and payment schedule of the selected property.
All dealings must be conducted in good faith and transparency.
5. Developer Obligations
Developers must honor the commission agreement signed with Mark Real Estate.
Timely payment of agreed commission upon closure of sale is mandatory.
Any project-related delays or issues are the responsibility of the developer.
6. Confidentiality
Both parties (Mark Real Estate and its clients/developers) agree to maintain confidentiality of proprietary and sensitive information exchanged during business.
7. Liability Disclaimer
Mark Real Estate acts only as a facilitator. It is not liable for any construction delays, legal issues, or developer defaults.
Clients are advised to conduct their own due diligence before finalizing any property purchase.
8. Termination
Either party may terminate the agreement with 7 days written notice.
Mark Real Estate reserves the right to terminate services in cases of breach, fraud, or non-cooperation.
9. Dispute Resolution
In case of disputes, both parties agree to attempt resolution through mutual dialogue.
If unresolved, disputes will be subject to the jurisdiction of courts in Gurgaon, Haryana.
10. Amendments
Mark Real Estate reserves the right to update or modify these Terms & Conditions at any time. Clients and developers will be notified of major changes.
11. Governing Law
This Agreement is governed by the laws of India and shall be interpreted accordingly.
